What are Tennessee's DUI laws and penalties?

Driving under the influence of any intoxicant including controlled substances, marijuana, prescription medications, substances that affect the central nervous system or any combination may result in DUI charges. Any person with a blood alcohol content (BAC) of .08% or higher, or .04% for commercial drivers, may be arrested. The severity of penalties for DUI is dependent on the number of prior DUI convictions on your record. Potential sentences include:

First offense – at least 48 hours in jail, 24 hours of community service, license revocation for one year and $350-$1,500 in fines.

Second offense – at least 45 days in jail, participation in a substance abuse program, license revoked for two years and $600-$3,500 in fines.

Third offense – at least 120 days in jail, participation in a substance abuse program, license revocation for 6-10 years and $1,100-$10,000 in fines.

Fourth and subsequent offensesClass E felony, one year in jail with at least 150 consecutive days served, license revocation for eight years and $3,000-$15,000 in fines.

Aggravated DUI charges result if your BAC is .20% or higher and enhanced penalties such as increased jail time and fines are also triggered. Tennessee also utilizes Ignition Interlock Devices that require drivers to submit to a breathalyzer test before starting a vehicle. Ignition Interlock Devices may be ordered in any DUI case, but are required if you have two or more DUI convictions within five years.
